CIRCULAR Detailing cross-border provision of public information Pursuant to the Government’s Decree No. 132/2013/ND-CP of October 16, 2013, defining the functions, duties, powers and organizational structure of the Ministry of Information and Communications; Pursuant to the Government’s Decree No. 72/2013/ND-CP of July 15, 2013, on the management, provision and use of Internet services and online information; At the proposal of the Director of the Authority of Broadcasting and Electronic Information, The Minister of Information and Communications promulgates the Circular detailing the provision of public information across the border. Article 1. Scope of regulation and subjects of application 1. This Circular details the cross-border provision of public information which is used in Vietnam or accessed from Vietnam (hereafter referred to as the cross-border provision of public information). 2. This Circular applies to domestic and overseas organizations and individuals involved in the cross-border provision of public information. Article 2. General provisions 1. Cross-border provision of public information means overseas organizations and individuals (hereafter referred to as foreign organizations and individuals) using websites, social networks, online applications, searching services and other similar online forms to provide public information which is accessed or used by users in Vietnam (including organizations and individuals). 2. Competent Vietnamese state management agencies have the rights to take necessary measures to ensure the enforcement of the policies on online information development and management prescribed in Clauses 4 and 5, Article 4 of Decree No. 72/2013/ND-CP in the following cases: a/ Foreign organizations and individuals providing public information across the border violate Clause 1, Article 5 of Decree No. 72/2013/ND-CP; b/ Foreign organizations and individuals fail to cooperate with the Ministry of Information and Communications in coordinating and handling information violating Clause 1, Article 5 of Decree No. 72/2013/ND-CP.
